Elderly driver caused my disability

Back in 2003 I was on my way to work when an eldery gentleman drove right into me and caused over $6300 worth of damage to my van. Yes, the van was totaled, but so was I. It's been five years since that accident and I am still suffering from it. I suffered soft tissue damage and nerve damage in my neck in that accident. I am now in pain 24/7 and have to take several different medications every 6 hours in order to be able to try to survive. I can't even say I am functioning because I am not. I lost, not only that vehicle, but my home, my furniture, and almost lost my children. We ended up homeless because I could no longer work to pay the rent. If my boyfriend had not allowed us to move in with him, we would have ended up living on the street, which would have caused me to loose custody of my kids. This man, at the time of the accident, had Parkensins disiease and also Alstimers (I know I didn't spell those right, sorry) and should not have been behind the wheel. But, because his family did not want to hurt his feelings, no one did anything and now my life has been ruined. Two minutes after the accident, he told the state trooper that he wasn't in an accident because he had already forgotten about it. He was sitting on the side of the road, but didn't remember why. When the state trooper told what had happened, he then tried to blame the accident on me, even though the evidence showed he hit me. He never did turn it into his insurance co as he, once again, forgot he had been in an accident. I am not saying that every senior citisen should be stopped from driving, as there are a lot of them that can drive well. However, I do strongly believe that there should be some kind of mandatory testing for EVERYONE once you reach a certain age. That way, an impartial party can decide if you are safe to drive or not, instead of leaving it up to family to "not hurt their feelings". We have to take a drivers test when we are teens in order to prove we can drive, why can't there be a test when you hit a certain age to prove you are still able to drive? At that age, say 65 or so, you go to get your license renewed and have to take a test to prove you can still drive....every time your license is renewed this should be done. I remember, this past April, I was in line to get my picture taken for my new license. In front of me was a man that I heard was 98 years old, getting his picture taken. His daughter had to explain to him...for 20 minutes...why he was there getting his picture taken. She had to spend another 10 minutes explaining why he had to sign his name and where, and another 10 minutes explaining why they had to leave. She didn't even bother to try to explain the question of if he needed to register to vote or not, she did that for him. Now, if this man could not even understand the concept of getting his picture taken, why was he allowed to get a drivers license? This was AT the drivers center and NO ONE there questioned why he was getting license. As I was leaving, he and his daughter were also leaving the center, and guess who was behind the wheel...that's right, he was. How scary is that?? I sincerely hope he has not caused an accident and ruined yet another single mothers life, like mine has been.
